So lets say the hearing on the 23 Aug is successful and the challenge can be heard. It might then be months before we get a result. If it is a negative result for the Force they will then look to take it to the next level (High court?). I assume the same process would occur with an injunction followed by a hearing to see if they have a case followed by the case itself. If things go that way we could still be doing all of this mid next year.

Are the Force then free to play in super rugby while all this is happening?

I'll stand corrected but I suspect the Supreme Court is the highest it can go.

The coaching staff and players are standing firm but they'll need certainty as the weeks/months pass by. There will be some very tempting offers from European and Japanese clubs, many of which would eclipse what they could get from a Super Rugby team. I would begrudge any of them if they took the cheese and added to their superannuation in Tokyo, Glasgow or Toulon.

don't know, I guess if an appeal is being heard then the appeal decision takes precedence over the arbitration decision.
Therefore until the appeal comes down the ARU does not have the right to kick us out? Therefore we should be treated the same as all the other Teams? so all are playing or none of us are?

That is what I was thinking, that we havent been kicked out until the court says we have.

But then we may not be able to play while the court process is underway so we might be kicked out by default?

This is a rugby forum, surely every second man is a lawyer, what is the go people!

I wouldn't think so, until there are no injunctions the ARU can't remove us. If they can't remove us we must be included.
Their obvious problem is the new format. So if all this goes long enough a 15 team format cannot be implemented.
They may have to go with a 16 team format which would be very good for us because it would have to be for the season whether we win or lose during that period.
By the end of that season you would think they would not be able to get rid of us regardless of legalities?
That's a long way off though.

Well if we last another season the VRU potentially will be in the shit again trying to run the Rebels, so they could potentially fold instead if the secret money doesn't come through.

Will "Chargedown" Genia is back to reduce the amount of spots available to Louwrens and Ruru, Australia's most promising half backs, and now Australia's most promising coach may be lost at the end of all this.

He is only mid 30s. He might think getting a few more development years might serve his development better. Part of his success as head coach in Perth was down to the support coaching staff he had, who were also excellent.

Any chance the Force could take the issue to the international Court for the Arbitration of Sport? They deal in contract disputes but not sure if the Rugby WA v ARU issue qualifies to be heard there?
