COVID-19 Stuff Here

I'm not a lawyer, nor do I play one on TV, but if the above is the case how do we not have mandatory vaccination across the board? Does Victoria have legislation that mandates any of this? Genuine question, not being a smart arse.
It is the same legislation that permits lockdowns. The underlying principle really is that everyone is locked down, but there are exemptions that allow you to work. The vaccine mandate narrows the scope of the exemptions, it doesn't force you to be vaccinated. At least that's the theory,

The reality is that there is a strong correlation between the authorised workforce, high case loads in certain LGAs and low vaccination rates. Hitting someone in the hip pocket is one of the most effective ways to change behaviour.

A strawman argument.
Ebola is a disease. Turning up to work with a disease will see you sent home.
No jab - no work refers to the "preventative" vaccine, not the disease of Covid.
To compare like with like, you would be advocating workplace discrimination against all those who refuse to be vaccinated against Ebola.
Or you could compare Covid to influenza.
In Australia in 2019 there were over 300,000 cases of influenza, approximately 4000 hospitalisations and over 800 deaths. There were no restrictions or lockdowns.
Ok - let's do that.

In 2020 there were 28,500 cases of Covid-19, about 3,500 hospitalisations and 909 deaths, and that was with restrictions and lockdowns.

I don't know about Victoria but in NSW there is pretty much unlimited scope for a public health order made under the Public Health Act. I assume it's similar in Vic. The leg in NSW: https://legislation.nsw.gov.au/view/html/inforce/current/act-2010-127#sec.7 Pretty broad powers.

Its a controversial issue and politicians are usually reticent to legislate if it's gunna hit their votes.

Mandatory vaccines could, in theory, be contrary to some form of federal anti-discrimination legislation. Federal leg > state leg in the case of a genuine conflict. I don't know shit about discrimination though - and don't really care to tbh.

From the Chief Justice of Victoria - The following update is from the Chief Justice of the Supreme Court of Victoria and Chair of Courts Council, Anne Ferguson, on behalf of the Victorian courts and VCAT. Legal challenges to directions under that Act (Public Health and Wellbeing Act 2008) have been brought before the courts. Those matters will be heard and determined according to law. The Courts and VCAT will therefore not be making comment or responding to inquiries that go directly or indirectly to questions of legality of the directions.
Your question will remain unanswered for the time being.

Not really. There is legislation.

Whether an order under that legislation is legal is another question. AFAIK there have been two legal challenges on restrictions in Victoria (one on constitutional grounds, one on proportionality of restrictions) and both failed.

This will be interesting as it plays out, but the key point will be that they are not forcing someone to vaccinate, just not allowing them to do specific jobs if they don't.

Not comparable to what happened in Melbourne last week but today "several thousand*" attended an anti-lockdown/ anti-vax rally in Auckland Domain & the cops did pretty much nothing about it. Being outdoors it probably won't result in as many infections as the Samoan AOG Church service back in August (~380 infections from ~500 attendees who had no way of knowing they were at risk) but it's probably the final nail in any hope there was of Auckland coming out of Level 3 next week.

* Edit: updated NZH article puts the turnout at "up to 2,000" which I guess is better than "several thousand" but the proverbial three men & a dog would've been better still.

Faaark! Covid has again leaked out of Auckland: one case in Raglan, literally at the end of the road I live on, another in Hamilton East so as of midnight tonight it's back to Level 3 for the North Waikato :(

Gotta bite the bullet like Vic & NSW me thinks. What's Auckland's roadmap like? Do you have an opening up date regardless of covid zero?

^ D-G of Health has said once a 90% vaccination rate is achieved future outbreaks can be managed without lockdowns. At current rates that's likely to be late November or early December. In terms of a road map out of lockdown for Auckland, announcements were due to be made tomorrow, not sure how today's cases will impact that.

Hotel quarantine continues to prove an interesting experience. My diminutive English partner and three other people recieved an 8 person armed escort including military personnel and a police car to her hotel.

Apparently, washing clothes is a significant health risk so shes not allowed to do laundry. For two weeks.

The Australian has a piece from James Allan headed "Covid hysteria based on lies, propaganda and ignorance".

One of his justifications is It’s a world where (according to the latest Stanford study) the survival rate for the unvaccinated for these age ranges is: 0-19 (99.9973 per cent); 20-29 (99.986 per cent); 30-39 (99.969 per cent); 40-49 (99.918 per cent); and the survival rate doesn’t drop below 99.7 per cent until you get to the over-70s.

According to those statistics there is no rational cause to enforce lockdowns, ruin small business, mandate vaccines, and bash protestors.

A blogger on another site had very similar experiences.
Additionally, his 20 minute exercise regime once a day was complained about by the quarantine "guests" on the floor below so he was banned from doing that too. Too much noise!

Yeah, I wore a bathrobe for the first week of my quarantine. Actually quite enjoyed it. Just worked, watched rugby and exercised. Didn't have to cook or clean dishes for a fortnight, was sah-weet.

I assume she's in Sydney? IIRC all Sydney hotels are pretty nice and bougie.

Yeah no complaints there. Raddison Blu - never been myself but her room seems fairly big.

Exact same hotel I was in. Miserable view with no sunlight for me but great rooms. Also, I happily ate all the meals, thinking they were absolutely fine. Then went onto a facebook group when I finished and everyone was in unison that the food was dreadful. Little bit embarrassed to realise I have very poor taste and am a pig.
