G&GR's Best Australian Club Rugby Try Promotion - Terms and Conditions

1) The Promoter is GreenandGoldRugby of Level 2, 303 Coronation Drive, Milton QLD 4064.

2) The information on how to enter this promotion and prizes form part of these Conditions of Entry. Entry into this promotion is deemed acceptance of these Conditions of Entry. Entry is accepted via Internet only.

3) Any costs associated with accessing the promotion website remain the responsibility of each entrant and are dependent on the service provider used. Any contact or other required entry details entered incorrectly on the website shall be deemed invalid and will result in an ineligible entry.

4) Entry into the promotion is free and open to any Rugby club in Australia.

5) Each entrant grants the Promoter and ARU a non-exclusive, royalty-free, perpetual, worldwide licence to reproduce and deal with any material submitted by all means whatsoever (including, without limitation, in print and electronic format).

6) No entrant will post any material:
[list type=lower-roman][*]which is not original work in which they own the copyright, or which in any way violates or infringes (or could reasonably be expected to violate or infringe) the copyright, registered trademark or intellectual property rights of another person;
[*]which is (or could reasonably be expected to be) obscene, offensive, pornographic, vulgar, profane, indecent or otherwise illegal;
[*]which is (or could reasonably be expected to be) defamatory of any person;
[*]which racially or religiously vilifies, incites violence or hatred, or is likely to offend, insult or humiliate others based on race, religion, ethnicity, gender, age, sexual orientation or any physical or mental disability; or
[*]which the entrant knows or suspects (or ought reasonably to have known or suspected) to be false, misleading or deceptive.[/list]

7) The Promoter retains the right and discretion to edit, delete, reject or remove any video posted.

8 ) Promotion commences at 10.00am (AEST) on Thursday 15 April 2010 and closes at 4.00pm (AEST) on Friday 8 October 2010. To enter the promotion, eligible entrants must, during the promotional period, log on to www.GreenandGoldRugby.com/clubtry/ to register and submit their video entry in the manner required. In order to fully complete the online entry form, the entrant must provide their club name, current and valid email address and telephone number. When submitting a video entry those details must also be provided for the name of the try scorer.

9) The Promoter accepts no responsibility for late, lost or misdirected entries. Incomplete, ineligible or incomprehensible entries will be deemed invalid.

10) All entries must be posted online in the manner required and received by the Promoter by 11:59pm (AEST) on each of the following days:

[*]June Try of the Month – entries posted no later than Friday 2 July 2010

[*]August Try of the Month – entries posted no later than Friday 27 August 2010
[*]September Try of the Month – entries posted no later than Friday 24 September 2010

11) Internet entries will be deemed to be accepted at the time of receipt or successful online posting (as applicable) and not at the time of transmission.

12) There is no limit to the number of entries clubs may submit each month.

13) All eligible entries will be judged by the Promoter. Chance plays no part in determining the winners. The judging will be based on individual skill levels of the players involved, level of teamwork involved in the lead up to the try and the level of innovation of attacking moves. Judges' decision is final and no correspondence will be entered into.

14) Each month a short list of five (5) tries will be selected by the Promoter and displayed on the promotional website and the ARU website for seven (7) calendar days during which time users will be able to vote online for their preferred try at www.GreenandGoldRugby.com/clubtry/. Users will be allowed one (1) vote during this seven (7) day period.

15) The video entry receiving the most votes at the end of the voting period will be deemed the winner of the G&GR Club Rugby Try for that month. In the event of a tie the video entry with the most selections as the top video entry will win the award and in the event of a further tie the Promoter will select the winning video entry from those that are tied.

16) The winner of the G&GR Club Rugby Try each month will be the player that scored the selected try and will be announced on www.GreenandGoldRugby.com and www.rugby.com.au the week following the seven (7) day voting period. The club whose player scored that try will be notified by email. All reasonable steps to notify the winner of the result will be taken by the Promoter.

17) The G&GR Club Rugby Try of the Year winner will be judged by Qantas Wallabies Head Coach Robbie Deans from the six (6) G&GR Club Rugby Try of the Month winners. The G&GR Club Rugby Try of the Year winner will be notified by e-mail and announced on www.GreenandGoldRugby.com and www.rugby.com.au by 4.00pm (AEST) Friday 8 October 2010. The player that scored the G&GR Club Rugby Try of the Year winner will be presented their prize by Robbie Deans at a Wallabies training session in Sydney in October 2010 – location, date and time to be determined. It will be the responsibility of the winner to make their own travel arrangements to this presentation.

18) The player that scores the G&GR Club Rugby Try of the Month will receive the following prizes:

[*]A voucher to the value of $500.00 to spend on any Skins products.[/list]

19) The club whose player scores the G&GR Club Rugby Try of the Year will receive the following prizes:

[*]A voucher to the value of $1,000.00 to spend on any Skins products.
[*]The G&GR Club Rugby Try of the Year trophy;
[*]A two-hour training session at the club with Robbie Deans in the 2011 pre-season – date and time to be determined. [/list]

20) The Promoter reserves the right to request a prize winner to produce appropriate documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the winner’s identity, age, eligibility to enter and claim the prize before issuing any prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or the winning entry has not been verified or validated to the Promoter’s satisfaction within the time requested, that winner’s entry will become invalid. If the entry of a prize winner is deemed invalid, the Promoter will award the prize to the entry that received the next highest number of votes.

21) If a prize winner is under 18 years of age, then the prize will be awarded subject to the winner’s parent or guardian accepting these terms of entry on the prize winner’s behalf and being responsible for the prize winner for the duration of any attendance to accept the prize.

22) Any prize (or any unused portions of prizes) is not transferable or exchangeable and cannot be taken as cash. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought.

23) The Promoter accepts no responsibility for any variation in any prize. If for any reason any element of any Prize becomes unavailable for any reason beyond the Promoter’s reasonable control then a similar prize element of equal or greater value will be awarded to the winner in lieu, subject to applicable legislation.

24) The Promoter and its associated personnel, agencies and companies shall not be liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with using any prize, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

25) The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry which is not in accordance with these Conditions of Entry, or if the entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

26) The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter.

27) The Promoter is not responsible for any problems or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a mobile network, or any combination thereof, or any other technical failures including any damage to entrant's or any other person's mobile handset or computer related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion.

28) If for any reason this promotion is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion, subject to any applicable legislation.

29) Entrants consent to the Promoter and ARU and its partners using the entrant's name, likeness, image and/or voice in the event they are a prize winner (including photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration or compensation for the purpose of promoting, publicising or marketing this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. The winners agree to participate in all reasonable promoted activities in relation to this promotion as requested by the Promoter and its agents.

30) Each entrant indemnifies, and must defend and hold harmless, the Promoter and its employees, servants, agents and contractors, from and against all Losses, howsoever caused and not limited to; arising from: a breach by the entrant of any of these Conditions of entry; any third party claim arising directly or indirectly from a breach by the entrant of any of these Conditions of entry; a negligent, wilful or otherwise wrongful act or omission of the entrant; fraudulent or dishonest acts or omissions by the entrant; any breach by the entrant of any applicable Laws; any claim by any third party (including individuals, legal entities and governmental departments or agencies) arising directly or indirectly as a result of the entrant entering this promotion; the death of, or personal injury to, any person or any damage to, or loss or destruction of, any real or tangible personal property, to the extent caused by any act or omission of the entrant; and any claim or allegation that the entrant’s entry infringes a third party’s Intellectual Property Rights or constitutes an unlawful disclosure or misuse or misappropriation of another parties trade secret or confidential information.

31) All entries and any copyright subsisting in the entries become and remain the property of the Promoter and ARU. The Promoter collects personal information about prize winners to award prizes. If the personal information requested is not provided, the entrant may not participate in the promotion. Each entrant also agrees that the Promoter may publish or cause to be published the winner’s name, and locality in any media in accordance with applicable lottery legislation. Entrants can gain access to, update or correct any personal information by contacting the Promoter at clubtry@greenandgoldrugby.com. All personal information will be stored at the office of the Promoter. A copy of the Promoter’s Privacy Policy in relation to the treatment of personal information collected may be obtained by contacting the Promoter at clubtry@greenandgoldrugby.com.

32) These terms and conditions shall be construed and applied in accordance with the laws of Queensland, Australia, and entrants consent to the exclusive jurisdiction of the Queensland Courts to determine any matter or dispute which arises under these terms and conditions in accordance with the laws of Queensland, Australia.
