Just going back to earlier in the week.........

AFL chief executive Gillon McLachlan has told club bosses that the AFL would have little choice but to follow rugby union’s hard stance on Israel Folau’s anti-gay comments if facing a similar scenario with a player.

McLachlan told a meeting of club chief executives late on Tuesday that the AFL’s commitment to inclusion — seen in the league’s display of the LGBTI flag at their headquarters — meant that they would be compelled to take a similar line against a player making the kind of anti-gay comments that have landed Folau in a legal fight to save his Australian rugby career.

^ it's first & foremost a test of employment law, I seriously doubt any judge is going to go near any of the other things you mention unless it somehow fails that initial test.

Question for the lawyers: can he actually proceed directly to "Supreme Court" action without first exhausting his other options, beginning of course with his right of appeal to a second CofC hearing?

Ugh, no it isnt. Its a contract issue. Its ridiculous how hard some people are finding it to wrap their heads around that.

The second panel hearing is an internal appeal option, basically a review. He can file a claim in a Court. Given 4 mil is the prize, Supreme Court is the correct jurisdiction.

^ that surprises me a little, over here you've pretty much got to jump through all the lesser hoops before the Big Wigs will even look at your case.

If Folau was to win it would have huge implications for employement law - corporates will equally watch this case with nervousness as would have implications for companies ability to protect their brands being damaged by their employees social media behaviour

It would be quite astounding if he won.

I'm guessing only burdening legal costs will put the stoppers on Folau's challenge.
I also guess he'll have a lot of support.
No one needed it but it's happening.
