He didn't make the second image. The second image wasn't doctored by an evil other party. It was just forwarded on. Apparently accidentally, according to Kurtley.

No Gagger. It doesn't. It was specifically not what the Tribunal found. He accidentally sent one image to DP, not two. The tribunal would not be interested in who authored it, just that KB (Kurtley Beale) sent it. He got a $45k fine for sending the one image twice, I assume additional punishment was in store if he sent both images.

It also does not make sense. Neither does the WS assertion that it was an MMS message which is different to Whatsapp. In the interests of full disclosure I cannot tell you the difference. I am advised that it is possible to "ghost" an MMS text so that it appears to come from another number. Apparently that is also functionality built into Skype so that it can identify a user from a phone number or something like that. Perhaps whatsapp works like that too?

Either way Beale definitely sent the one image twice. He says so and his phone says so. You, Slim and Wayne must have a missing piece you are not telling us about or I am just thick as two short planks.

Either way I am happy to leave the topic here until such time as a technical expert posts some explanations for public consumption.

As an aside I think that is quite important since the witch hunt has started looking for the second texter. Pretty unfair to allow that speculation to occur. Unless you know exactly who authored it and how it got on to DP's phone it is pretty reckless starting to list out individual players.

Please take it slowly for me because Smith's article is not clear.
How did the second image/message get attached to Beale's message.
Beale's telephone records don't seem to indicate that it was attached, unless the tribunal got it completely wrong.

Can you actually spell out what you are saying?
1. Are you saying Beale is lying and he did send the second text image/message?
2. Are you saying there was not enough evidence thatthe second image was sent by Beale? (even though his telephone records indicate it wasn't sent from his phone?)
3. Are you saying Beale forwarded a message from a third party which included his original message? (if so wouldn't it be obvious to Beale/Patston/Pulver who the forwarder was and wouldn't they have have been exposed.)

I didn't state it as fact as I agree not all facts are clear as yet.

However, as I have read it, Beale has denied authoring the second image. That is different from sending it.

In telephone billing records, a slideshow will just register one SMS being sent, not tell you what was in it. I believe more than one image can be sent in whatsapp or MMS as a slide show.

Interestingly, I note that no one has actually talked about Beale's phone being submitted, just account records (telephone and Whatsapp). If this is the case, where is his phone? As she was an ARU employee, I would assume DPs phone is with the ARU.

Perhaps the identity of the writer of the second image had been cropped off it before it was sent?

So leaving all the technical stuff aside Muglair, what is now your position?

Only yesterday it was that there was clearly a huge body of evidence painted by reliable reporting in SMH and News Ltd that you felt strongly indicated some wrong doing by Patston, which is why people should lay off KB (Kurtley Beale).

Now you seem to be out there to protect the poor second texter.

Just what are you trying to say?

I suppose we could ask the simple questions like the fact that the whatsapp is designed to transmit via the web, not like sms or mms. There is no cost (as its part of your data) so there is no cost log.

So I suppose we could just ask a simple question of why do forensics on the phone as when you install whatsapp it uploads you whole phone book and logs every use of the app? The data is not on the phone, rather on the web.

So, as it by design links to facebook, I would assume an image could be authored on facebook, and sent / or access it from the authors phone to be sent via a third party app, which depending on the app, may or may or may not show on the phone.

Just like deleting the history in your browser I suppose, or un-installing and re-installing an app, these action could explain why there is no trail on a phone.

It took the NRL less than a week. Open, shut, now piss off Gallen. Meanwhile, we've managed to get to 162 pages talking about Beale.

I know it's not exactly the same, but they sure as shit didn't dick around.

I don't think you'll get many arguing with you as I'm sure just about everyone would've preferred that's how KB (Kurtley Beale)'s incident was dealt with too.

You are right that they're not exactly the same also but I'm pretty confident that had Beale tweeted his messaging instead of texting, then I think the outcome would've been the same as for Gallen.
